We reached a pre-trial $5 million settlement for birth-related injuries against a major health care institution in New York. The case involved a mother whose fetus was not diagnosed as suffering from intrauterine growth restriction. The baby was not timely delivered, and now suffers from multiple complications secondary to a permanent brain injury sustained at the time of birth. She will require extra care for the rest of her life. The case was settled in accordance with the Medical Indemnity Fund that was established by the New York State Legislature in 2011. This means that, in addition to the multimillion-dollar settlement, the New York Medical Indemnity Fund will pay for all future medical costs for the girl.
